Terms of Service

These Terms of Service govern your use of KaraokeSmith, a software application developed and sold by Dane Hartman, an individual ("we," "us," or "our"). By downloading, installing, or using KaraokeSmith, you agree to these terms.

1. License

Upon purchasing a license, we grant you a personal, non-exclusive, non-transferable, perpetual license to install and use KaraokeSmith on any computers you personally own or control. You may not sell, sublicense, rent, or redistribute the software or your license key.

2. Trial

The free trial permits full use of the software for up to 10 songs, after which a license purchase is required to process additional songs. Previously processed songs remain fully accessible after the trial limit is reached.

3. Acceptable Use

You may use KaraokeSmith to process audio files you own or have the right to use. You are solely responsible for ensuring your use of the software does not infringe on third-party copyrights or other rights.

4. Payments

Payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record. Your purchase is subject to Paddle's terms and conditions in addition to these terms. We do not store your payment information.

5. Disclaimer of Warranties

KaraokeSmith is provided "as is" without warranty of any kind. We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements. Your use of the software is at your own risk.

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KaraokeSmith, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for your license.

7. Changes to These Terms

We may update these terms from time to time. Continued use of the software after changes are posted constitutes acceptance of the revised terms.

8. Governing Law

These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.
